These Terms & Conditions (“Terms”) govern your access to and use of portersgolf.com (the “Site”) and any purchase of products or services from Porters Golf (“we”, “us”, or “Porters Golf”). By using the Site or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site or place orders.

• Orders placed on the Site are offers to purchase. We may accept or decline orders at our sole discretion.
• Acceptance of an order occurs when we send an order confirmation email. Payment authorization is not acceptance.
• We reserve the right to correct pricing, product information, and availability errors at any time.

• Accepted payment methods are shown at checkout. Payment is charged per our checkout terms (typically at shipment).
• Buyers are responsible for applicable taxes, duties, and import fees unless we state otherwise.
• Shipping, handling, and freight charges are calculated at checkout; free-shipping promotions may exclude certain items.

• Delivery dates and times are estimates only. We are not liable for carrier delays.
• Large or heavy items (e.g., carts, simulators, launch monitors) may ship via freight with separate terms; product pages will indicate freight requirements.
• Risk of loss passes to the buyer upon carrier pickup. Inspect shipments and report visible damage per our Returns policy.

• Manufacturer warranties, if any, are passed through to the buyer; contact the manufacturer or us per the product warranty details.
• EXCEPT AS EXPRESSLY PROVIDED, THE SITE, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PORTERS GOLF, ITS AFFILIATES, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SITE. OUR AGGREGATE LIABILITY ARISING FROM OR RELATING TO ANY ORDER OR THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE APPLICABLE ORDER.

All content on the Site, including text, images, logos, and software, is the property of Porters Golf or its licensors. You may use Site content only for personal, noncommercial purposes. Reproduction, modification, distribution or public display is prohibited without written permission.

• Account holders are responsible for maintaining confidentiality of login credentials and for all activity under their accounts.
• We may suspend or terminate accounts where there is suspected fraud, abuse, or violation of these Terms.

You agree to indemnify, defend, and hold harmless Porters Golf and its officers, directors, employees and agents from claims, damages, losses, liabilities and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your use of the Site, or your violation of law.

These Terms are governed by the laws of the State of [State Name], without regard to conflict-of-law principles. Parties will first attempt to resolve disputes informally.
